Even worse is when the cause of death is uncertain, and the start of your proper grieving and healing period is delayed by the necessity of ongoing legal proceedings and paperwork associated with a coronial inquest. If your family member’s cause of death is currently the subject of a coronial inquest, then Stacks Law Firm is here to help.
What is a coronial inquest?
A coronial inquest is an investigation into the cause of somebody’s death. In NSW, the Coroner’s Court will call for a coronial inquest in any circumstance under which the cause of death is uncertain, or where death has been the result of anything other than natural causes. The inquest itself is a court hearing in which the Coroner examines evidence in order to determine the cause of death.
If your family member’s cause of death is being investigated, it’s best to consult a lawyer as early on in the process as possible, for a number of reasons.
Sometimes a lawyer must attend to help determine who the defendant should be, in the case where a number of people were involved in the incident which resulted in the death. In other situations, evidence gathered in a coronial inquest may be used in a subsequent personal injury compensation claim. In this case, you may want a lawyer to be present to ensure all the right questions are being asked, and the necessary evidence is gathered for later use in the compensation claim.
Your lawyer will be able to advise you as to whether or not it is necessary to have a lawyer attend the coronial inquest. If your lawyer does deem it necessary to attend the coronial inquest on your behalf, then they will ensure that all the right questions are being asked on behalf of yourself and your deceased family member. Our goal is to gather as much evidence as possible to allow you to make a strong compensation claim after the conclusion of the inquest.
