When you retain Stacks as your personal injury lawyers and we agree to act for you on a “no win no fee” basis, that means we will not charge you any professional fees – the fees we charge for work performed by us – unless we achieve a successful outcome for you. In most cases we will also pay disbursements throughout the claim, which are the out-of-pocket expenses that need to be paid to other people on your behalf in order to progress your claim, such as to doctors for medical reports.

If your claim is unsuccessful, however, you may still be required in certain circumstances to pay the professional fees and disbursements incurred by your opponent. We will not pass on to you the costs we incurred running the case.

If you decide to stop your claim or move your claim to another law firm, you may need to pay the costs of running your claim up to that point.

Yes. Before we start any work on your behalf, we will provide you with information about the estimated costs of our legal services and the payment arrangements which apply in your case, as well as explaining how our fees are calculated. This information will be set out in a written Costs Agreement which we will discuss with you and ask you to sign before we start work on your claim.

We assess each enquiry on a case-by-case basis and will normally agree to act in a personal injury case against an insurance company on a “no win no fee” basis when we believe that the case is reasonably likely to succeed.

In NSW workers compensation matters, once a matter has been accepted by the Workers Compensation Independent Review Office (WIRO) our fees are normally paid by them – not you – irrespective of the outcome.

How much compensation you are able to claim is dependent on many factors, including, for example, how and where the accident occurred, the injuries sustained, your age, economic and non-economic losses, present and future care required as a result of the accident, medical or other expenses incurred, as well as possible future expenses.
