Broken bones and fractures

Commonly asked questions about broken bone compensation claims:

If you have broken or fractured a bone or multiple bones as a result of someone else’s negligence, you may have a case for compensation.

Broken Bones compensation can be claimed to account for and pay for things such as:

  • Loss of income due to an inability to work following breaking or fracturing a bone
  • Surgery to re-set the broken bone
  • One-off and ongoing medical and rehabilitation costs
  • Loss of wellbeing and enjoyment of life
  • Chronic pain and suffering
  • Legal costs associated with your case

The amount that you can potentially claim for your broken or fractured bone will depend on where the break has occurred, the severity of the injury, how much of a full recovery you are expected to make, and whether you have directly lost income as a result of your injury. Stacks will carefully compile all legal and medical evidence around your case and help you seek the maximum claim entitlement possible for your individual case.

In NSW, claims for broken bone compensation must be filed no later than three years from the date of the injury, for incidents where the injury took place on or after 6 December 2002.
