    Making a workers compensation claim

    Unlike other types of personal injury claims, you do not need to prove fault to receive workers compensation. You just need to be able to show that the conditions of your employment were a significant contributing factor to causing your injury.

    Workers compensation also covers you if the primary income earner of your household has died or is severely injured in a workplace accident.

    To lodge a claim under the NSW Workers Compensation Scheme, you will need to:

    • See your doctor to get the appropriate written medical forms and advice, both for your own healthcare and to obtain the official doctor’s certificate required to lodge a workers compensation claim.
    • Inform your employer and make sure that your complaint or injury is recorded at your employment.
    • Your employer will fill out a workers compensation claim form with you. They will then be responsible for contacting your workplace’s insurance company. Under Australian law, all employers must have workers compensation insurance.

    FREQUENTLY ASKED QUESTIONS

    You must make a workers compensation claim within three years of your injury. After this period, it is extremely difficult to receive any payments, although there is still a possibility of some compensation.

    To receive workers compensation, it does not matter if you were partially at fault. You will still receive all of your weekly payments.Β 

    If you are suing for damages, however, and the court decides that you were partially at fault, your compensation award will be reduced by the level of your responsibility. For example, if the court determines that the accident deserves $50,000 compensation, but that you were 50% at fault, you will receive half of that amount – $25,000.

    Stacks Law Firm, Taree has a no win, no fee policy for workers comp cases. We will not charge you any fees if you should lose your case, which would be unusual, as our experienced solicitors know how to compile a thorough claim and will tell you upfront if we think your case has problems.Β 

    Once a matter has been accepted by the Workers Compensation Independent Review Office (WIRO), they normally pay our fees – not you – irrespective of the outcome.

    If you are suing for damages (for example, for a permanent injury), we generally pay for all your outgoing costs, such as disbursements for medical reports, which will be reimbursed to us by the insurance company once your claim is successful.Β 

    The insurance company will also cover most of the legal costs with us – the gap is generally about one third, which you pay to us from your compensation payout.

    Workers compensation insurers want to be sure that your injury is as debilitating as you say it is. Like any company, they do not want to pay out money unless they are sure your claim is legitimate.Β 

    To do so, insurers require:

    • Medical documentation of your injury
    • Sometimes a second opinion from a different doctor of their choosing
    • Details of any other workers compensation claims you have made in the past
    • Potentially details of your employment history

    In Australia, each state and territory has a statutory authority to administer its own workers compensation Act. In NSW, this is WorkCover NSW.Β 

    The authorities for the other states and territories are listed below.

    • South Australia – WorkCover Corporation
    • ACT – WorkSafe ACT
    • Northern Territory – NT WorkSafe
    • Tasmania – WorkSafe Tasmania
    • Victoria – WorkSafe Victoria
    • Western Australia – WorkCover WA
    • Queensland – WorkCover Queensland

    If you are receiving workers compensation payments, they will come in weekly instalments and will be taxed.Β 

    However, if your compensation is for damages, you will receive a lump sum that will be tax-free.

    Yes. You do not need to go to court to receive a fair workers compensation payout.Β 

    Typically you lodge a claim due to your injury, receive your compensation, and then return to work once you are able. If there are disputes involving your claim in NSW, a WorkCover medical specialist or someone appointed by the Personal Injury Commission will assess your claim.Β 

    Generally, the only time you may need to go to court is if you are involved in a complex common law claim.

    In cases where you feel your employer has breached a contract or duty to you, you may wish to lodge a common law claim. This may occur after you have already received workers compensation benefits.Β 

    A common law claim means that you will be suing your employer, and the court will decide on any common law damages.Β 

    Time restrictions for lodging this type of claim are very specific. After your injury is assessed by WorkCover NSW, it will create a β€œNotice of Assessment” which offers a lump sum monetary figure.Β 

    You must respond to this offer within 20 days. It should cover damages such as pain and suffering, lost wages, medical expenses and legal expenses.

    It is highly recommended that you speak to a workers compensation lawyer at Stacks Law Firm, Taree before deciding whether to accept this offer, because you may be entitled to much more compensation than the Notice of Assessment offers you.Β 

    For example, if your injury is permanent, a common law settlement can compensate you for the rest of your working life. However, if you sign the initial Notice of Assessment offer, you will be unable to pursue further common law damages.

    It is not mandatory to have a lawyer complete your workers compensation claim. However, it is highly recommended, given the complexity of dealing with insurance companies – especially while you are injured or unwell.
