    FREQUENTLY ASKED QUESTIONS

    Each state has its own set of compensation laws which vary slightly from one another. That means that if you were involved in an accident while travelling interstate, the rules and time limits for making a claim may differ slightly.

    Different states have varying time limits for making motor vehicle accident claims, and time limits also vary depending on what type of claim you are making. 

    In Taree, just as in the rest of NSW, if you are making a personal injury claim for expenses exceeding $5,000 or a treatment time exceeding six months, then this must be done within six months of the accident occurring.     However, if you are making an Accident Notification Claim for up to $5,000 to cover your medical expenses, your claim must be made within 28 days of the accident occurring. This claim needs to be lodged with the CTP insurer of the other driver.

    Given that some injuries like whiplash can take weeks or months to manifest, it is useful to have documentation of the accident as soon as possible, regardless of whether you are experiencing pain. This includes:

    • A police report covering the date, time and circumstances of the accident, as well as any witness details
    • A medical check-up with your doctor

    In NSW, if you were at fault in the accident, you may still be able to claim an early payment of $5,000 to cover medical expenses and loss in earnings. 

    In addition, you may also be entitled to receive support from the NSW Lifetime Care and Support Authority if you have suffered catastrophic injuries as a result of a motor vehicle accident – regardless of whether you were at fault or not.

    According to the State Insurance Regulatory Authority, you can be found to be partly at fault in the accident if you were:

    • Driving at an unsafe speed
    • Not wearing a seatbelt
    • Not wearing a helmet on a motorcycle or bicycle
    • Driving under the influence of alcohol or drugs
    • Travelling in a vehicle when you knew the driver was affected by alcohol or drugs

    The level of cover you receive in the event of a road accident is different for all private health insurance providers. Some providers may only cover you for your immediate hospital admission expenses if you have been injured in a car accident. 

    Check with your individual insurer for more details about your level of cover.

    If you are the driver or passenger of a vehicle involved in a single vehicle accident, then you may not be entitled to compensation, even if the accident was not your fault and was caused by sudden illness, such as a stroke or heart attack, or the vehicle experienced a sudden mechanical fault like a brake failure, resulting in the accident.

    Yes. All kinds of bicycle accidents may be covered, including accidents in which:

    • Two or more bikes have collided with each other
    • A car or other vehicle has run into your bike
    • You run over a pothole or other patch of damaged road on your bike, causing you to fall
    • You have had to make a sudden action to avoid the negligent driving of another vehicle, causing you to fall

    If possible, take a photograph of the place where the injury occurred, and photos of your injuries and damage to your bicycle. If the crash involved another cyclist or the driver of another vehicle, get their contact details, including their license and registration number. Also try to get the contact details of any witnesses.

    Many bicycles today are expensive and can cost almost as much to replace as a car. 

    If your bike has been seriously damaged in the accident, or if you had valuables on you at the time of the accident that were also damaged, then in some cases you may be able to claim compensation for these as well. 

    You will need to know the exact value of the items that were damaged, or if not, the approximate cost of replacing them.

    A hit and run accident is where a pedestrian or cyclist or driver of a vehicle has been hit by another vehicle, whose driver then drives away without stopping or giving their details to the injured person. 

    If you have been involved in a hit and run accident, then you are still eligible to claim compensation. The same applies if the driver was driving an uninsured vehicle.

    The first thing you should do after being injured in a public transport accident is seek medical treatment for your injuries, and if you are able, report the incident to the police. 

    If you have a camera phone with you, take photos of your injuries and the site of the accident if possible. These may be used as evidence by your lawyer when building your case to claim compensation. 

    Ensure you keep all receipts and records of any medical treatment and doctor and hospital visits following your accident.

    Following a fatal road accident, you may be able to claim compensation for:

    • Funeral costs
    • Hospital or ambulance bills prior to the person passing away
    • Loss of financial support as a result of the person passing away
    • Loss of duties or services that the deceased had been providing to the family
    • Rehabilitation costs for any psychological effects as a result of the person passing away

    This will depend on who is found to be negligent, and to what extent. For example, if the person who died was partly responsible for the accident, it may still be possible to claim compensation, but not as much as if they had died through no fault of their own.

    You may still be able to seek compensation if the accident was no one’s fault. For example, the accident may have resulted from a driver suffering an illness (eg a seizure) while driving, or from a tree falling on the road.
