    Conveyancing is the legal process of transferring the title of a property (that is, the government record of who owns it) from one person or company to another. The conveyancer is the person responsible for transferring the title.

    No. You can go through a conveyancing-only company. The advantage of using a conveyancing lawyer is that you have all the bases covered in the event of a dispute with a vendor, purchaser or tenant.

    There is no fixed time from when you enter into a property contract through to final settlement and payment. There are different parties involved and many variables, some of which can be open to negotiation between the buyer and seller.

    A conveyancer will do various searches on a property in order to find out who has the title and whether there are any special conditions related to it. 

    This could include easements or covenants over the land (for example, an electricity authority may have a right of way to access the property to maintain or repair equipment), or any boundary changes.

    After the buyer signs the contract of sale, there is a period of five business days during which they can change their mind and incur only a small termination fee. This is usually 0.25% of the purchase price of the property.

    In NSW, there is no cooling off period if a property sells at auction, or if contracts are exchanged on the same day that the property was passed in at auction.

    Stamp duty is a tax charged by the state government when you buy a property. The amount will depend on the property’s value and whether you are entitled to any concessions, such as the First Home Owners Grant.
