Commercial litigation
The lawyers at Stacks Champion understand the value of mediation in helping people resolve disputes at a modest cost. Whenever possible we try to help our clients avoid the expense and unpredictability of litigation.
But when litigation becomes unavoidable, we can draw upon years of experience to help our clients defend their rights.
We have acted for businesses and individuals in a wide variety of disputes. This includes defending the rights of a small roofing panel manufacturer whose designs were stolen by a much larger company. This commercial litigation produced a successful result in the Federal Court, with our client’s claims being vindicated and its intellectual property rights being upheld.
We often act for builders or property owners on building disputes, in matters involving negligent building work and asbestos. Our clients include both landlords and tenants in matters related to leasing disputes, such as those involving reinstatement of premises.
We act for liquidators and Revenue NSW in a range of business scenarios.
Small business advisory and employment law
Beyond litigation and dispute resolution, we provide restructuring advice to companies which are facing debts and need to chart a course to a sustainable future.
We help many small business clients with contract drafting, joint ventures, shareholder agreements, business succession planning and general advice in business law.
Our work in the corporate sector also includes employment law, where we act for both employers and employees in many industries in matters involving unfair dismissal, contract disputes and a wide range of workplace matters.
Estate planning, probate and disputed estates
We provide estate planning advice to many clients whose situation is multifaceted, with blended families, children from more than one partner and multiple business interests. We know how important it is for an estate plan to be nuanced and carefully balanced to minimise the risk of litigation after the will maker passes away.
Disputes related to the administration of estates can be complex. We have acted on many probate matters involving competing interests and disputes between warring executors.
Another important part of our wills and estates work is acting in family provision claims, where an individual feels they have been wrongfully left out of a will, or where they feel they have been provided for insufficiently. We have acted both for the claimant and for the estate in such matters.
In our experience, many such cases are successfully settled through mediation, without the need for litigation through the courts.
